Right of Way

License

A License is required for the installation and maintenance of infrastructure within the Middle Rio Grande Conservancy District (MRGCD) rights-of-way, including buried and aerial utilities, culverts, and bridge crossings. Typical processing period is 8–12 weeks. All installations must be made per MRGCD standard specifications.

Special Use License

A Special Use License is required for temporary use of Middle Rio Grande Conservancy District (MRGCD) rights-of-way for construction, pumping (in/out), research, commercial boating, filming, special events, and special activities. Typical processing time is 1–2 weeks. Please note contractors making installations of licensed infrastructure are required to obtain a Special Use License. Fees vary based on request.

Land Sales Application

Members of the public may inquire of the Middle Rio Grande Conservancy District (MRGCD) on the sale or exchange of any property rights (Lands) by the MRGCD. This inquiry will initiate a process by which first the MRGCD determines whether those Lands are eligible for sale or exchange. When MRGCD Lands are eligible for sale or exchange, those inquiring will submit a formal application to pursue the sale or exchange of those Lands. Typical processing time is variable.

Applicants are responsible for all costs associated with the sale of MRGCD Lands, including but not limited to the non-refundable application fee, costs of survey, costs of appraisal, costs of advertising, and costs of use of a title company for transfer. The Land Sales Policy was revised and approved by the MRGCD Board of Directors in October 2012. We request that you read and understand the Land Sales Policy before submitting your inquiry.

Traffic Gates

Residents may request the installation of traffic gates to close vehicular traffic on Middle Rio Grande facilities. Traffic gate installations will be cost shared between requestor(s) and the Middle Rio Grande Conservancy District (MRGCD). Typical processing time is 3–6 months.

Requestors are responsible for all material costs; MRGCD will fabricate, install, and maintain gates. MRGCD will not grant keys to gates, even to the gate requestor and impacted residents. The traffic gate policy was revised and approved by the MRGCD Board of Directors in November 2020.

Vegetation Removal

Residents may request the removal of vegetation within Middle Rio Grande Conservancy District (MRGCD) rights-of-way. All requests must meet MRGCD criteria for request approval. Typical processing period is 3–6 months.

Application for trimming and removal of vegetation within MRGCD rights-of-way is pursuant to MRGCD tree removal procedure and applicable state statute. MRGCD will not remove vegetation on private property. Residents have the right to trim any vegetation overhanging private property at the property line.
